Terms and Conditions for Users of the Ctelecom Service Application
Introduction
This software has been designed and developed to provide repair services for electronic products such as mobile phones, tablets, etc., either at the user’s location or at C-Telecom service centers. Users can submit their repair requests through the software, after which the defective item will be collected and, upon completion of the repair, returned to the user.
In general, the obligations of all parties related to the software—including the user, courier, technician, software owner, and others—are governed by the laws of the United Arab Emirates. However, with respect to the matters outlined below, these terms represent the final agreement of the parties and shall serve as the basis for determining responsibilities.
1. Definitions
- User: An individual requesting electronic repair services who has registered a request through the software and received a tracking code.
- Courier (Transport Agent): Any individual assigned by the software (couriers are provided by representatives) to collect or deliver items to the user.
- Technician: Any individual assigned by the software to perform repair services.
- Software Owner: Company IKIN mobile phones, registered under number 557538111 in the United Arab Emirates, responsible for managing and operating the software.
2. User Responsibilities
- The user undertakes to truthfully declare the defects of the item requiring repair. If additional defects are discovered during the repair process, the user shall be responsible for the costs associated with resolving those defects.
- The user must be present at the specified address and time indicated in the software to hand over the item to the courier. Failure to be present will result in additional transportation charges for subsequent visits.
- The user is responsible for verifying the identity of the courier and obtaining a receipt for the handover of the item. Otherwise, all responsibilities related to the item shall remain with the user.
- The user must pay the repair costs as stated; otherwise, the item will not be returned, and the right to recover repair costs through the sale of the item or any other lawful means is reserved.
- The user must personally (not through a third party) receive the repaired item and inspect it in the presence of the courier. If the item has not been repaired, the user may refuse delivery. However, if the user accepts the item, they waive any right to claim regarding repair quality, newly arising defects, etc.
- The user may not send items valued above 7500 AED through the courier and must deliver such items directly to the technician. In case of violation, all responsibilities shall lie with the user.
- The user must declare the actual value of the item in the software. Once the item is delivered to the technician, the technician will assess its value. If the user-declared value exceeds the technician’s assessment, the technician’s valuation shall prevail.
3. Responsibilities of the Courier (Transport Agent)
- The courier must arrive at the specified time and address indicated in the software to collect the item from the user or any person present at the address and must immediately deliver it to the designated technician.
- The courier is not responsible for verifying the identity of the person handing over the item and shall simply receive the item and deliver it to the technician.
- The courier must comply with all transportation laws and regulations in the United Arab Emirates and shall be liable for any violations, including penalties and damages to the item, toward both the user and the software owner.
- The courier must deliver the item to the technician as quickly as possible and obtain a receipt confirming delivery.
- The repaired item will be delivered to the courier in sealed packaging. The courier must deliver it to the user in the same condition. If the seal is broken, the courier shall be liable to compensate the software owner for any damages.
4. Responsibilities of the Software Owner
- The software owner is responsible for coordinating the collection of items, delivery to technicians, and return to users.
- The software owner shall assess the qualifications of technicians, couriers, and other service providers but bears no liability for their performance. If the software owner compensates for damages caused by such parties, they reserve the right to recover the amount from the responsible party.
5. App Permissions & Data Collection:
- Camera and gallery: the possibility of taking a new photo directly from within the application.
This access is enabled only when the user selects the "take photo" option.
The app never uses the camera in the background or without the user's knowledge.
Ability to select a photo from the device's album.
The application does not have access to any non-image files (such as documents, videos or audio).
The profile picture is saved on the server only after the user's final confirmation.
No images will be uploaded or shared without the express permission of the user.
- Location access: The location is never saved on the server except in two cases: 1. The user has confirmed the on-site repair request (temporary storage to coordinate with the technician) 2. The user gives separate permission to save the location to improve the service, after the service is completed, the location data will be deleted.
It is possible to turn off location access in device or application settings;
In this case, the application works based on the city or region entered by the user (with less precision).
These regulations are binding on the parties as long as they do not conflict with the laws of the United Arab Emirates.
